Kemptville jail opposition scores legal victory as case can proceed

Article content Opponents of the province’s plan to build a new jail on Kempville farmland will have their day in court after a judge ruled their case can proceed with a judicial review. Article content Justice Robert Smith said in his ruling this week that the opposition group’s legal effort to overturn the province’s decision should be heard by a full judicial panel of the Divisional Court. The judge noted in his decision that the province “failed to follow several provisions of its provincial policy statement when deciding to build a correctional facility in the town of Kemptville.” The ruling clears yet another hurdle in the ongoing efforts by grassroots opposition groups — the crowdfunded legal challenge is headed by residents Kirk Albert and Victor Lachance — to reverse the province’s decision to build the proposed 235-bed Eastern Ontario Correctional Center in their community.…

‘Keira’s Law’ passes the Senate, signaling a change to the way courts approach domestic violence

A private member’s bill requiring that judges consider domestic violence and coercive control when issuing decisions passed the Senate on Tuesday evening. Bill C-233, which was sponsored by Liberal MP Anju Dhillon, was introduced in February 2022. It was dubbed “Keira’s Law” after four-year-old Keira Kagan, who was found dead with her father at the bottom of a cliff outside of Toronto in 2020. Keira’s mother, Jennifer Kagan-Viater, said at a press conference on Wednesday morning that she tried to call attention to the danger her daughter’s father presented to their child well before their death. She said she went to court to seek protection for Keira from the violent and coercive behavior of her ex-husband Robin Brown.…
